Stages 1 and 2: Prevailing Wage Determination and Mandatory Recruitment
The roadmap begins with filing for a Prevailing Wage Determination (PWD / Form ETA-9141) through the National Prevailing Wage Center to ensure the salary offer does not adversely depress local labor standards. Following wage issuance, the employer must launch a strictly regulated domestic recruitment campaign spanning major Sunday newspaper notices, state workforce agency job orders, and internal posting notices to test the domestic labor pool in good faith.
Stage 3: Submitting Form ETA-9089 and Form I-140 Immigrant Petition
If recruitment fails to produce able and qualified domestic applicants, the sponsor submits Form ETA-9089 to the DOL. Upon certification (and clearing potential audit inquiries), the employer files the Form I-140 Immigrant Petition with USCIS, evidencing company ability to pay the prevailing wage and unlocking the final adjustment of status phase.
